Terms of Service.

Plain English, because a two person studio has no reason to hide behind eight pages of boilerplate. These terms cover the Growth Plan and any one off build we agree to. Using this site or starting a plan means you accept them.

01Who you are dealing with

NexomateStores is a two person web studio. Alex handles direction and everything client facing. Shafiq handles the build and the delivery. There is nobody else, which is the point. Reach either of us at alex@nexomatestores.com.

02What the plan is

The Growth Plan costs $499 per month and includes:

Unlimited requests. They sit in a queue and we deliver one at a time.
A new delivery every 24 hours, up to 15 in a month. If you send more than that, the extras stay in the queue for the following month.
Unlimited revisions on whichever request we are actively working on.
Front end work: websites, storefronts, landing pages, marketing sites, and motion or 3D on the web.

Not included, so nobody is disappointed in week two: full backend platforms and custom app development, native mobile apps, anything needing a vendor contract we would have to sign for you, ongoing copywriting as a standing service, and video production. One off single page builds are available on request at a price we agree in writing first.

03You see it before you pay

Before any money moves, we build the first version of your homepage and put it on a real, live URL. Look at it, open it on your phone, sit with it. If you do not want to go ahead, say so and you owe nothing. Nothing is charged until you have seen that page and told us to start. We would rather lose a day of work than argue about an invoice for a site somebody never wanted.

04Billing, and the fact that it renews

The plan is $499 per month, charged in advance, and it renews automatically every month until you cancel.
The first charge only happens after you have seen your first build and asked us to begin.
Payment is handled by our payment processor. We never see or store your card details.
If the price ever changes, we will tell you at least 30 days before it affects you, and you can cancel before it does.

05Pausing and cancelling

Cancel or pause any time by emailing alex@nexomatestores.com. No contract, no notice period, no cancellation fee, no retention phone call.
Cancelling stops the next charge. The month you have already paid for runs to the end and we keep delivering through it.
We do not refund a month that has already begun, because the work is delivered continuously across it. If we have delivered nothing at all in a paid month, email us and we will make it right.
We can end a plan too, with a month's notice, or straight away if these terms are broken.

06What you own

All of it. Once a deliverable is paid for, the work we made for you is yours. It ships on your domain, in your accounts, with the source code handed over. There is no proprietary platform you cannot leave and no fee for leaving it. If you cancel tomorrow, your site keeps working. Third party parts we use on your behalf, such as fonts, stock images or plugins, stay under their own licences.

07What we need from you

Your content. Text, images, logos, video. You confirm you have the right to use whatever you send us.
Your own accounts and costs. Domain registration, hosting, paid fonts, stock imagery and any third party service you want connected.
Your replies. The queue only moves as fast as feedback comes back.
Nothing illegal. We will not build anything unlawful, deceptive, or designed to harm people.

08Regulated industries

We build sites for insurance agencies, general agents, financial services, healthcare, legal and other regulated businesses. Read this part twice if that is you.

We are a web studio, not a compliance service. We are not licensed insurance producers, brokers, attorneys or financial advisers, and nothing we build is legal, insurance or financial advice.
You own the compliance of your content. Regulatory approval of your copy, disclosures, disclaimers, licence numbers and advertising claims is yours, including anything your carrier, general agent, state regulator or CMS requires. Send us the approved wording and we will build it exactly.
Medicare work needs sign off before we build. Medicare Advantage and Part D marketing sits under CMS rules, including the required third party marketing organisation disclaimer. We will not publish a Medicare page until your compliance contact has approved the content in writing.
Lead forms and calling consent. If a form is going to feed phone calls or texts, you supply the consent wording your counsel approves. We are not responsible for how leads are contacted afterwards.
We do not build forms that collect health information or other sensitive personal data as standard. If your workflow needs it, say so up front so it can be handled properly rather than bolted on.
You indemnify us for claims arising from content you supplied or approved, and from your own regulatory obligations.

09The rebuilds of real brands on this site

Some of the work shown here is an unsolicited concept redesign of a real company. Those are demonstrations of our own craft. They are not affiliations, endorsements, partnerships or client relationships, and we do not claim any. All names and trademarks belong to their owners. If you own one of those brands and would rather we took the page down, email alex@nexomatestores.com and we will remove it, no argument.

10What we do not promise

We build front end websites, and we are good at it. We do not promise business outcomes: traffic, search rankings, conversion rates or revenue depend on your market, your offer and your prices as much as on your site. The work is provided as is. To the fullest extent the law allows, our total liability for any claim is limited to what you paid us in the three months before it arose, and we are not liable for indirect or consequential loss such as lost profit or lost data. Nothing here limits liability that cannot legally be limited.

11Changes to these terms

If we update these terms, the date at the top changes. If a change materially affects an active plan, we will email you before it takes effect.
